Intergovernmental Review of Federal Programs (E.O. 12372, 43 CFR 9,
                          and the Intergovernmental Cooperation Act of 1968)
 

(1) This executive order is intended to foster an intergovernmental partnership by relying on
State processes and on State, areawide, regional, and local coordination for review of proposed
Federal financial assistance and direct Federal involvement.

(2) It is applicable only to the extent that the States desire consultation with the Department.

(3) Suggested language for the ROC and preamble where consultation with States has occurred:

"The Service reviewed this rule under E.O. 12372 and accommodated the recommendations of
State and local governments concerning Federal programs affecting their jurisdictions."

(4) Suggested language for insertion in the ROC where consultation has not occurred (Note that
are not required to include this statement in the preamble of your rule if no consultation occurred.):

"The Service has reviewed this rule under E.O. 12372 and determined that intergovernmental
consultation is unnecessary."
